			<content:encoded><![CDATA[<p>There are several factors that may affect the value of a personal injury case.  That being said, there is no exact science to the evaluation of any accident case. An experienced personal injury lawyer can help you analyze your case.  Here are some factors that might influence the evaluation:</p>
<p>1) The severity of the impact.  If you show a jury a photo of your vehicle, and they have to squint to see the damage, you will have an uphill battle getting any sympathy from anyone.</p>
<p>2) The severity of the injury.  Soft tissue sprains and strains don&#8217;t impress adjusters anymore.  Even more, juries won&#8217;t want to give you the time of day.  Therefore, if all you have is a soft tissue injury, do your best to settle before you take your case to trial.</p>
<p>3) Your age.  Simply put, the older your are, the more susceptible you are to injury.  If I get a case with a plaintiff in his/her 20s, I tell them right off the bat, they&#8217;re going to have a hard time convincing an adjuster they had appreciable injury.</p>
<p>4) Residual injury.  If you have injuries that won&#8217;t resolve and are projected to last a long time (or indefinitely), that may affect your case.  Also, permanent injuries can affect the value of your accident case as will anything requiring surgical intervention.</p>

			<content:encoded><![CDATA[<p>During a lawsuit, each side to the lawsuit has the right to &#8220;discovery.&#8221; That means, each side can &#8220;discover&#8221; more about the opposing party&#8217;s position by obtaining documents, asking written questions, etc.  There are definite formalities to the process which befuddle most members of the public.  It often appears to be more &#8220;form over substance&#8221; but that&#8217;s the way the system is designed.  It also take a long time to occur.  In California, most lawsuits last at least one year.  Keep in mind a lawsuit is usually only filed if a case is unable to resolve prior to litigation.  When you file a lawsuit, you essentially start over again.  </p>
<p>During a lawsuit, a “deposition” (or several) may be taken as part of the &#8220;discovery&#8221; process.  You’ve certainly seen them on television – a lawyer is asking questions of a witness and there are other lawyers in the room along with a court reporter writing everything down on a cool nifty machine as fast as possible. Usually, on TV, there is high drama with most of the attorneys sparring and yelling at each other. Some add fist-pounding! Truth is most depositions are boring events with questions being asked from every conceivable angle. Sometimes clients have a hard time understanding why the questions are so detailed. Sometimes the truth is indeed in the details, but the attorneys are trying to learn more about what a witness might say in court….and not just WHAT they might say, but HOW they say it. If an attorney is taking your deposition, they are not only evaluating what you are saying but also your witness potential. They are asking themselves, “How well would this person testify before a jury? How likable are they? How believable are they? How much conviction does this person have? Do they keep changing their story? Do they appear to be honest?” Let’s face it, juries vote for people they like &#8211; just like anything else in life. In my career as an attorney, I firmly believe the deposition is the most important part of the “discovery” process. In many cases, a good deposition (or a bad one) can change the the course of a case. Make sure you prepare for your deposition by discussing what to expect with your lawyer. </p>

			<content:encoded><![CDATA[<p>Sometimes, filing a lawsuit and going to trial in your personal injury case is not the best course of action. In fact, after all the years I&#8217;ve been in practice (for both plaintiff and defense), I cannot remember a single time when my client or the client for the other side said they enjoyed the process and would do it again.  No one walks out of that courtroom saying, &#8220;Gee that was fantastic! Let&#8217;s do that again!&#8221; </p>
<p>Going through litigation is a very difficult experience and is never fun.  Sure, there might be the rare person who enjoyes antagonism and the adversarial process. However, most people aren&#8217;t wired like that.  It is intrusive, expensive, and frustrating to say the least. In most cases, the result is not what you would have wanted. Therefore, I always encourage my clients to thoroughly explore diplomatic solutions before they file a lawsuit. </p>
<p>Diplomatic solutions include negotiations with the insurance adjuster, lienholders, doctors, etc.  Also, there are alternative dispute resolution (ADR) methods such as mediation and arbitration that should be thoroughly explored before filing a lawsuit. After filing a lawsuit, one should always keep their options open and entertain these alternative methods as well. Remember, you want to resolve your case on her own terms rather than leave it up to 12 jurors who don&#8217;t know you.  If you settle your case, at least it&#8217;s your choice and you have some control over the outcome. Your expectations may be thwarted when it comes to a jury who doesn&#8217;t necessarily share all your opinions.</p>

			<content:encoded><![CDATA[<p>If you have an accident in California but live out of state, you can certainly have a California lawyer handle your matter.  Even though you live in another state, that doesn&#8217;t mean you have to use a lawyer in your state.  If the accident happened in Los Angeles, for example, you may likely have to file a lawsuit in Los Angeles if your case doesn&#8217;t settle.  Therefore, you might be better off having a local California attorney handling your case. However, if you seek medical treatment in another state, you will need to really help your lawyer gather all records and billing.  Sometimes, it is more difficult to obtain records and billing from out of state.   I am currently handling two personal injury cases that occurred in the Santa Clarita area, but the clients live in other states.</p>

			<content:encoded><![CDATA[<p>I met with a client today, and that was the very question we discussed.   He was in a relatively minor accident but was feeling a little stiffness in his neck.  Because there was very little visible damage to his vehicle (and not much to the other vehicle either), I was not inclined to represent him.  I was very honest with this gentleman.  I told him that his case wasn&#8217;t going to be worth much because of the minor damage.  I explained that most insurance adjusters generally equate minor damage with minor injuries (or not at all).  While I encouraged him to seek medical care for his condition, I explained that bringing a claim for personal injury requires work.  You can&#8217;t just sit there at home and expect your claim will be successful.   For this particular client, the incident was so minor that he decided it wasn&#8217;t &#8220;worth it&#8221; for him to bother.  Bringing a personal injury case isn&#8217;t always warranted, and in some cases, may not be the best thing for the client to undergo.  Bringing a claim requires active participation.</p>

They will offer to meet you at your home to &#8220;discuss&#8221; your case.  Make no mistake&#8230;they are not interested in &#8220;discussing&#8221; your case. They are there to offer you a quick, low-ball settlement. Insurance adjusters are often rewarded for &#8220;closing&#8221; files and resolving them quickly.  For some companies, the longer a file remains open, the more questions are asked by supervisors.  So the adjuster will meet with you and convince you they have tons of experience with cases just like yours and that $500 should be enough settlement.  They will have their checkbook for sure.  Remember, insurance companies don&#8217;t make money by paying claims. They make money by taking in premiums.  If the insurance adjuster wants to meet you, talk to a lawyer first.  Never sign anything until you run it by an experienced lawyer.  If you sign your rights away, and accept a low-ball settlement, then you cannot come back later and ask for more.  </p>
